December 30 wrongful death bike and big rig accident in Riverbank near Atchinson and First Streets

On December 30 a woman was killed when she was hit by a big rig while riding her bike in Riverbank near First and Atchinson Streets. Reportedly the woman had gotten off her bicycle to walk the bike across the street when a truck was turning right onto Atchinson and hit her in the crosswalk. She was dragged approximately 100 to 200 yards then fell underneath the truck and was run over. She died immediately. This accident can easily be ruled a wrongful death as it seems that the woman was in the crosswalk and had dismounted the bike to cross the road. The attorneys of Nelson and Rozier specialize in wrongful death claims. While our condolances go out to the friends and family of the victim, we recognize that no monetary sum can ease the pain and loss felt after a tragedy such as this. However, just monetary compensation can help ease the burden of medical bills, final expenses, and help support any dependants left behind by the deceased. Please contact us at http://www.nelsonrozier.com/ or call attorney John Rozier at 559-713-0159 if you would like help filing a claim.

New Section of HIghway 180 opened December 3

The ribbon cutting ceremony for the new section of Highway 180 between Clovis Avenue and Temperance Avenue was held this morning. This new section of Highway will reduce commuter traffic and therefore make the roadways of Fresno County a little bit safer. This project was funded through Fresno County's half cent transportation sales tax and Measure C. The next project on Highway 180 will be to widen the section between Temperance and Academy Avenues. http://www.nelsonrozier.com/

Fog continues throughout the Valley

Heavy fog was reported this morning on the Fresno-Tulare County line. Visibility was reportedly 500 feet or less. Further south on Highway 99 visibility was reported at 200 feet. Southbound Highway 41 between Manning and Nebraska had reported visibility of 300-400 feet. Motorists are cautioned to drive more slowly during foggy conditions. A vehicle should be able to stop within the visibility range. For instance, if visibility is 500 feet, the vehicle should be going slow enough to reach a complete stop within 500 feet. This will ensure that the driver will not be caught off guard by hidden obstacles and will have adequate time to stop. http://www.nelsonrozier.com/

Court awards close to half a million in wrongful death suit

Two years ago Karen Jen was tragically killed when she was out for her daily walk when she was hit by Craig Howard as he was driving home from work. The Fresno County Superior Court awarded the plaintiff, Jen's son, $452,680 for this wrongful death case. Howard was on his cell phone when the accident happened. He had placed calls back to work, but the jury decided that the calls were not required as part of his job. If it had been decided that Howard was "on the job" the settlement could have been much larger as corporations, or cities as is the case in this instance, generally have larger insurance policies to pull from. If you have been involved in an accident with someone who was on the job at the time of the accident the corporation may possibly be held partially at fault. http://www.nelsonrozier.com/

On Thursday, December 3 a ribbon-cutting ceremony will be held for the new extension of Highway 180 between Clovis and Temperance Avenues. There will also be a ground breaking for the widening of Highway 180 from two to four lanes between Temperance and Academy Avenues. Both of these projects will ease traffic for commuters. November 23 Highway 99 Accident in Bakersfield

November 23, 2009--Early yesterday morning a 40 year old Los Angeles man named Fredrick Scott sustained major injuries in a rear-end collision on Highway 99 near Ming Avenue. According to the Bakersfield Californian, Mike Koshkaryan, age 48 of Glendale stopped for an accident up ahead and was then rear-ended by Scott who was transported to Kern Medical Center in Bakersfield.

Issues to be resolved include whether those involved in the collision up ahead may have some responsibility for this later accident. On occasion, such as during a fog multi-vehicle collision, it is helpful to determine who caused the original accident and whether later accidents were foreseeable consequences of the first mistake. Further, if it can be shown that Mr. Koshkaryan was himself speeding then his insurance may come into play. This accident occurred about 70 miles south of the Law Offices of Nelson and Rozier in Visalia. Please call us if you would like us to send an engineer to the scene of the accident to investigate these issues further. www.nelsonrozier.com

November 17 Highway 41 accident in Madera County happened on a deadly stretch of road

The accident on Highway 41 in Madera County on November 17 that claimed the lives of two Coarsegold residents happened on what many consider to be a deadly stretch of road. The stretch of road known as Rocky Cut sees 20,000 cars pass through every day. According to Cal Trans traffic on Highway 41 has increased by 70 percent in the last 8 years. That is not only local traffic, but also visitors to Yosemite National Park and Chuckchansi Casino. The Highway Patrol estimates that around 50 people have been killed on the stretch of Highway 41 between Fresno County Line and Yosemite National Park in the last 6 years. Just Last August 3 women were killed in a head on collision that occurred just south of Tuesday's accident. Many claim that the road is safe, it is the drivers who need to be more cautious. Others claim that  it is an "unforgiving roadway." http://www.nelsonrozier.com/

More people than expected not wearing seat belts

On Novemebr 18 the Bakersfield Californian reported that 51 people were cited with not wearing seat belts just on Union Avenue. National studies have shown that 90 to 95 percent of people comply with the seat belt law. Fifty-one citations on one road in one day seems proportionally high. By not wearing a seat belt a motorist is putting themself at risk for being ejected from the car should a crash occur. Seat belts have been proven time and time again to save lives and are worth whatever discomfort or inconvenience may come from buckling up. Don't become a statistic. http://www.nelsonrozier.com/

Highway 46--Blood Alley upgrade

November 7, 2009--According to the Bakersfield Californian, a section of Highway 46 in Kern County will soon become a 4 lane expressway.  The bad reputation of this roadway dates back to the death of Michelle Phillips in 1999, or even back to the death of actor James Dean in 1955.

The Highway 46 widening project will be done in stages.  A ground breaking ceremony will occur on Tuesday at the Lost Hills Park with construction set to begin on November 16, 2009.  The plan is to provide a generous median strip to buffer the opposing lanes of traffic.  However, a similar upgrade to Highway 41 east of Selma resulted in a post-construction fatality when a second stop sign was not provided to force crossing traffic to cross the expressway in 2 stages.  It is our contention that the wide median in that case in part caused another accident and that state design manuals mandated a second stop sign.  Suit was filed in that action by Attorney John Rozier of the law firm of Nelson & Rozier in Visalia in the past couple of months.  Discovery will soon be initiated including the depositions of CHP and Cal Trans personnel.  www.nelsonrozier.com

Highway 119:  636 crashes, 16 fatal crashes
Highway 223:  271 crashes, 12 fatal crashes
Highway 178:  456 crashes, 11 fatal crashes
Highway 184:  870 crashes, 9 fatal crashes
Highway 43:  335 crashes, 8 fatal crashes

Los Banos Jack in the Box accident

Discovery is ongoing for a trip and fall claim, actually in this case a slip and fall claim, which occurred at one of the Jack in the Box locations in Los Banos, California.  The injured party had been at the counter ordering food when he went around the corner towards the restrooms and slipped on a puddle of water.  While signs had been placed on the floor, they were visible only for those entering the premises.  The claimant now requires surgery.

If you have been involved in a trip and fall or slip and fall accident in California, you should be aware that not all claims have validity.  The general rule is that the store or restaurant will not be held liable unless it created the hazard itself and failed to adequately warn its customers, or if the condition was known to exist or should have been known to exist for a sufficient length of time to remedy the condition.  Please feel free to call us if you think you may have a claim.  Further, we all suffer small bangs and bruises.  Only serious injuries warrant a full investigation.   Often surveillance videos or store accident reports can be very helpful in establishing a claim.  Please call for a free consult.  Visalia, California Attorney John Rozier 559-713-0159.   www.nelsonrozier.com

Visalia woman files suit over nursing home death

November 7, 2009--A Visalia woman is filing suit over the death of her mother in a nursing home.  After being allowed to attend a doctor's appointment without an escort, albeit in a wheelchair and with an oxygen tank, the nursing home resident fell from the chair and fractured her leg in addition to facial injuries.  When returned to the nursing home after leg surgery in the hospital, medical care was inadequate leading to sepsis and double pneumonia and eventual death.  The California Department of Health Services investigated this death and issued two large fines (each nearing $18,000) against the facility.  Paperwork is now being circulated by the Law Firm of Nelson & Rozier preparatory to filing suit which should take place within a week.

Wrongful death claimants in a case such as this follow California laws of inheritance without a will--in other words the rules of intestate succession.  The surviving spouse, surviving children, and even grandchildren may have a claim if their parent does not survive.  If you have a family member who has been mistreated at a nursing home please call Attorney John Rozier at 559-713-0159.  www.nelsonrozier.com

Steven Herrera mauled by pit bulls in Bakersfield

November 3, 2009--A 35 year old Bakersfield man named Steven Herrera was attacked and mauled by 3 pit bull dogs on Tuesday afternoon.  The Kern County attack is similar to several other pip bull attacks in the valley as reported on recently in this blog.  In this case Mr. Herrera was saved by the efforts of a neighbor named Andy Casteneda who swung his cane at the dogs before they could chew the arm off of the victim.  The owner of the dogs, Salvador Romero is the brother of the victim.  www.nelsonrozier.com

November 3 Pit Bull Attack in East Bakersfield

On the afternoon of November 3 Steven Herrera was mauled by 3 pit bulls in east Bakersfield. Andy Casteneda, a witness to the attack, stated that he could hear Herrera screaming from four houses down. Casteneda went to help Herrera with only a wooden cane as a weapon. He stated that the biggest of the three dogs was "chewing the man's arm off." He also said that the two female dogs were on Herrera's legs.

Other neighbors heard Herrera's cries but were hesitant to help. It was the 69-year-old Casteneda who came to the rescue, using his cane to beat the off of Herrera long enough for him to run to safety. Another witness, Damon Hill, said he though Herrera would have probably been killed had no one gone to help him.

According to City Animal Control Field Supervisor, Tammy Davis, the dogs belonged to the vicitm's brother. The brother's had met up earlier in the day and the dogs were not friendly towards Herrera. Herrera does not visit often and the dogs were unfamiliar with him. Herrera arrived at the home before his brother arrived home and proceeded inside the gate, despite the "Beware of Dog" sign.

Herrera was taken to Kern Medical Center to treat his wounds. He was listed in fair condition. The dogs have been placed on quarantine for 10 days. The owner initially stated that he would not try to get the dogs back, but later stated he might return for the two pregnant famales. The dogs were not neutered, were unlicensed, and there was no record of them having received the proper rabies vaccinations. Since the dogs were on their property they will be returned to the owner, unless Herrera's wounds are deemed severe enough to warrant a vicious dog hearing. Davis has stated that "having access to dogs of such ferocity just by lifting a gate latch is a safety issue in the neighborhood."

At Nelson, Rozier we have experience representing dog bite victims. If you or a loved one has been a victim of a dog attack please contact us at http://www.nelsonrozier.com/ for a free consultation.
