Fog accident in Bakersfield kills truck driver

February 18, 2010--According to the Bakersfield Californian newspaper, last Thursday's wrongful death accident in Bakersfield involved a carrot truck driven by Jose Mascareno, age 43 of Bakersfield.  It was struck by a pick-up and both vehicles burst into flames.  Fog was a contributing factor.  The big rig accident scene was at Interstate 5 and Taft Highway.

Further investigation is required to determine if the big rig driver shares liability for the death.  Each vehicle's event data recorders can be downloaded to determine speeds, etc.  This needs to be done before the vehicles are repaired or junked.  We recently handled a similar accident where a milk tanker turned in front of a truck injuring every member of a family from Selma.  We were able to recover several hundred thousand dollars for our clients even though the police report blamed them for the accident.  They truly were not the sole cause of their accident.  Please call us on Monday  559-713-0159--our offices are located about an hour from the scene of this accident and we can come to you for a free consultation.  Attorney John Rozier.http://www.nelsonrozier.com/

Foggy road near Delano leads to wrongful death of Wasco man

February 2, 2010--According to the Bakersfield Californian newspaper, Tuesday's fatal crash between a truck and a big rig took place in heavy tule fog near Delano.  The decedent was identified as 34 year old Moises Vargas Gonzalez of Wasco.  He was driving northbound on Highway 43 when a big rig driven by Casimiro Casares made a left turn in front of him.

This is very similar to another case handled by our office where we were able to collect a substantial settlement from the left turning truck in a fog accident.  In that other case the police report also blamed the driver who had the right of way.  By looking at the black box data in the air bag module, and by hiring an accident engineer we found a bend in the road which contributed to the accident and otherwise were able to show that the tanker driver should not have made his turn at that location.

If hired by the family of Moises Vargas Gonzalez we will do a similar investigation to see if shared liability can be shown.  Please call his family to offer our services.  http://www.nelsonrozier.com/

February 2 wrongful death accident in Bakersfield at Ashe Road and Panama Lane kills Michelle Maxwell

On February 2 Michelle Maxwell was killed in a wrongful death accident at Panama Lane and Ashe Road in Bakersfield. Michelle Maxwell was riding in the passenger seat of a Hyundai driven by her 15-year-old daughter, Michaela Maxwell. They were traveling north on Ashe Road, having just turned off of Panama Lane, when the car was hit on the passenger side by a Ford F-150 pickup. The pickup was driven by Mitchell Green. Reportedly Green had run a red light. There was no sign of the truck having braked at all before the crash.

The crash caused Green's pickup to hit a power pole and catch fire. Other motorists pulled Green from the burning vehicle before emergency crews arrived. The power pole was severed as a result of the crash. This knocked out power to 4,600 customers.

Michaela Maxwell suffered many injuries as a result of the crash. She underwent surgery for a broken wrist, broken leg and facial and stomach bruises. Michelle Maxwell is remembered as a wife and mother who served her community and loved babies.

Green's injuries were originally listed as moderate, but later he was listed in critical condition at Kern Medical Center and was later transferred to Fresno Community Regional Medical Center. Green, an off-duty fire fighter, is said to have been drunk at the time of the accident. He will be booked into jail with charges of vehicular manslaughter and felony drunken driving.

The attorneys of Nelson and Rozier send their condolences out to the Maxwell Family. While monetary compensation cannot bring back the deceased it can help to cover the final expenses of Mrs. Maxwell as well as pay for medical bills and pain and suffering for Michaela Maxwell.
